Managing Multi-Contract Disputes with a Multi-Party Agreement

With the rise of mega-projects, it has become increasingly common for infrastructure projects to be delivered under several head contracts, rather than just one.  This strategy has many advantages, but it also creates contract interface risks for the project owners.  For example, the activities of one head contractor can delay or disrupt those of another, resulting in claims against the project owner for extra time or money, which trigger related claims by the project owner against the contractor that caused the delay or disruption.  This often results in the project owner becoming involved in multi-contract disputes under two or more contracts, each with its own dispute resolution process.  The project owner’s involvement in parallel dispute resolution processes results in additional costs, complexity, and inconvenience, as well as ‘gap risk’ from differing determinations in each process.
 

Owen’s presentation will explain how project owners can better manage these risks through the use of multi-party agreements that enable dispute avoidance and streamline the dispute resolution process for multi-contract disputes.
