The concept of force majeure, literally ‘superior force’, originates from Roman law (vis major) and is recognised in civil law systems, notably through the French Civil Code. Under English common law, however, force majeure is not a legal doctrine; it exists solely as a creature of contract. Its scope, effect, and remedies depend entirely on how it is drafted, including the events covered, risk allocation, relief mechanisms, and claims procedures. In construction contracts, force majeure serves as a contractual tool to manage risk, clarify obligations, and address claims arising from unforeseen events.

    Biography

    Dr. Nuwantha Uduwage is a Senior Lecturer in the Department of Building Economics at the University of Moratuwa, Sri Lanka. He is a Chartered Quantity Surveyor of the Institute of Quantity Surveyors Sri Lanka (IQSSL) and a Corporate Member and Certified Quantity Surveyor (CQS) of the Australian Institute of Quantity Surveyors (AIQS) with professional and academic experience across Sri Lanka, Thailand, and the Middle East.

    Dr. Uduwage holds a PhD in Procurement from Thammasat University, an MSc in Construction Law and Dispute Resolution, and a BSc (Hons) in Quantity Surveying from the University of Moratuwa, along with a Diploma in Arbitration. His teaching areas include contract law, claims management, and commercial management, with particular emphasis on construction contracts, procurement systems and dispute resolution.

    His research interests focus on AI-enabled applications and advanced analytical methods for construction management and public procurement, with emphasis on contract management, decision-making, optimisation, policy formulation, and forecasting.
