VIC CPD Event – Navigating the long-awaited amendments to Victorian Security of Payment Act: Insights from Industry Experts

Victoria’s amended Security of Payment Act (SOP Act) overhauls industry risk allocation and dispute resolution by introducing sweeping reforms that significantly reshape the state’s construction industry.

 

For independent delay and quantum experts, the most significant change is the complete abolition removal of Victoria’s unique “excluded amounts” regime. With these restrictions removed, the approach to preparing, assessing, and disputing delay and quantum claims will fundamentally change, influencing how such claims are formulated, evaluated, and contested across the industry.

 

Join us for an upcoming session where we will examine the key legislative changes. The discussion will consider the implications of the amended SOP Act from the perspective of independent delay and quantum experts.

    Head of Expert Services, APAC

    Dominique has more than 25 years of experience in the delivery of infrastructure projects in Australia and overseas, from project planning to handover. She has held roles in project planning, engineering, and project delivery for both government and private organizations. Dominique has prepared advice and expert reports in relation to delay, delay costs, disruption, and disputed variations for a variety of projects for the purposes of arbitration and litigation.
    Dominique has provided expert evidence and advice to clients in either preparing or responding to claims for time and cost.
    Dominique’s international experience includes her role as Capital Works Project Manager for Veolia Water in Indianapolis. She successfully managed the delivery of projects to meet time and budget requirements and developed capital works plans.

    Biography

    Director, Quantum Expert

    John is a Chartered Quantity Surveyor and testified quantum expert with over 30 years of pre- and post-contract experience across the construction, engineering, and power industries in Australia and internationally. He is dual qualified in both technical and legal disciplines. He has extensive experience in contractual claims preparation and defence and is frequently engaged as a quantum expert witness in both arbitration and litigation proceedings.
    John brings significant expertise in pre- and post-contract measurement and valuation, as well as the commercial and contractual aspects of construction management, gained through work on a wide range of projects.
    He has undertaken various aspects of construction dispute resolution, including arbitration, mediation, and adjudication, and is a qualified Adjudicator. John has managed numerous adjudication and mediation submissions relating to the resolution of construction and engineering disputes.

    Partner in the Construction and Infrastructure Group at Holding Redlich

    Lachlan has over 14 years of experience managing construction disputes in Victoria and Australia. He is highly experienced and successful in bringing and defending 'security of payment' claims in Victoria advising in approximately 70 matters over his nine years at Holding Redlich. He has presented and written extensively on the recent changes to the Victorian security of payment regime.
    Lachlan also has significant experience in advising on contractual disputes during a project's lifecycle, as well as major building defects disputes, including in relation to combustible cladding, exploding glass balustrades, and a diverse range of defects in apartment and other buildings throughout Victoria. An experienced construction and commercial litigator, he acts for builders, subcontractors, owners corporations, private owners, government departments, Victorian municipal councils, building and design consultants, water authorities and insurers.
