WA Chapter Event: AS2124 and NCW4, Exploring the Practical Implications of Each

For many years, WA State Government projects have predominantly utilised AS2124 as the standard form construct-only contract. As a result, AS2124 has also become widely recognised and commonly adopted in the private sector.

 

Over time, however, AS2124 has increasingly been accompanied by extensive special conditions and amendments. These amendments can significantly alter the risk allocation, leading to industry criticism that AS2124 is becoming outdated in current project delivery models.

 

The WA State Government is now considering other contracting options, including the NCW4 for some of its building projects.

 

Join Isla McRobbie, Partner at Jackson McDonald, as she explores the key differences between the widely recognised AS2124 and the NCW4 framework, including the practical implications, shifting risk allocation principles, and the critical issues contractors, consultants and principals should be aware of as the industry moves toward a new procurement landscape.

    Biography

    Isla McRobbie is a Partner in the Projects, Infrastructure and Construction team at Jackson McDonald, with more than 30 years of experience in the building and construction industry (10 years of that as a practicing architect). She advises a diverse range of clients on all aspects of front-end construction procurement, from early-stage strategic advice and procurement methodologies through to risk allocation and mitigation.

    With her background as a practising architect, Isla brings valuable hands-on construction experience to her legal practice and has built a highly regarded career as a construction lawyer. She was recently recognised with the Architects Board Award for her outstanding contribution to the architecture profession and the broader community. She has built extensive experience in, and developed good insight into the key issues experienced by the broader construction sector.

    Isla has extensive experience advising on major infrastructure procurement and complex development projects, including multi-storey modular apartments and hotels, build-to-rent and medium-density developments, regional asset maintenance agreements, tertiary education facilities, aged care and retirement living projects, as well as government and affordable housing developments.
